AGREEMENT TO MEDIATE

1. Nature of Mediation


​The parties understand that mediation is a voluntary, non-adversarial process. The mediator’s role is to facilitate communication and assist the parties in reaching a mutually acceptable agreement. The mediator is a neutral third party and cannot provide legal advice or act as an advocate for either side.


​2. Confidentiality


​In accordance with Florida law, all communications made during the mediation process are confidential and privileged.
​Statements made during mediation cannot be used as evidence in any subsequent legal proceeding.


​Exceptions: The mediator is required by law to report any threats of physical violence, suspected child abuse, or elder neglect.


3. Scheduling Agreement


 By mutual agreement, the mediation process may be conducted in multiple sessions rather than a single full-day intensive. This phased approach allows the parties to focus on specific topics—such as parenting plans, equitable distribution, or communication protocols—in dedicated blocks of time. 


This structure provides participants the opportunity to deliberate on specific proposals and consult with outside counsel or financial experts between sessions, ensuring a more thoughtful and durable final agreement. 



​4. By signing this, the parties agree to:


​Engage in respectful communication.
​Focus on future solutions rather than past grievances.
​Disclose all necessary information in good faith to reach a resolution.


​5. No Legal Representation


​Melissa Micucci is a Certified Mediator, not an attorney for either party. Each party is encouraged to seek independent legal counsel to review any final settlement agreement before signing.


​6. Fees Payment


​Mediation Fee:


$200/Hour 


Payments can be made through Paypal at  paypal.me/mel14321


​Payment: Due at the End of the session. Payments can be split between parties if necessary.


$200 Deposit due 3 days prior to mediation date.


​Cancellation Policy: Notice must be provided 24 hours in advance to avoid a cancellation fee.
